    The Business Innovation and Investment (Provisional) Visa (subclass 188).


    Visa 188 has 4 Streams.

    1. Business Innovation Stream is for business owner who want to set up a company, develop and manage a company in Australia.


    2. Investor Stream: who wants to invest in 1.5 million AUD in Australian Bond in 4 years.


    3. Significant Investor Stream: who wants to invest in 5 million AUD in Australian Bond in 4 years.


    4. Premium Investor Stream: who wants to invest in 15 million AUD in designated investment and Australian Bond in 4 years.


    For type 1 and 2, the Visa Applicant must have 65 points to be eligible for an invitation.


    Business Innovation Stream

    Inorder to apply for this Visa you must:

  • • Be under 55 years of age, unless being waived this condition.
  • • Invited by the State.
  • • Score at least 65 on the points test.
  • • Have an overall successful business career.
  • • Have a genuine desire to continuously own and maintain a management role in a business in Australia.
  • • Have had an ownership interest in an established business or businesses that had at least AUD500 000 turnover in each of two our of 4 recent years.
  • • If your business a turnover of less than AUD400 000 per year, you must own 51 per cent.
  • • If your business a turnover of more than AUD400 000 per year, you must own at least 30 per cent,
  • • If it is a publicly listed company, you must own at least 10 per cent.
  • • You and your spouse must own at least 800,000 AUD (in business and personal assets) and can transfer such money to Australian within 2 years after being granted a visa.

  • Investor Stream

    Inorder to apply for this Visa you must:

  • • Be under 55 years of age, unless being waived this condition.
  • • Score at least 65 on the points test.
  • • Have a high level of management skill in relation to the eligible investment or qualifying business activity.
  • • Have at least three years' experience of direct involvement in managing one or more qualifying businesses or eligible investments.
  • • Have an overall successful record of eligible investment or qualifying business activity.
  • • Have a genuine and realistic commitment to continuing your business and investment activity in Australia after the original investment has matured.
  • • Have a genuine intention to live for at least two years in the state or territory in which you have made a designated investment.
  • You, your partner, or you and your partner combined must:

  • • For at least one of the five fiscal years immediately before you are invited to apply, have directly managed one of the following:
  • • A qualifying business in which you, your partner or you and your partner combined had at least 10 per cent ownership interest, or
  • • Eligible investments owned by you, your partner or you and your partner combined of at least AUD 1.5million.
  • • Have investment and personal assets of at least AUD 2.25 million that are available for legal transfer to Australia within two years of the visa being granted.
  • • Make a designated investment of at least AUD 1.5 million in a state or territory government security for 4 years.
  • Significant Investor Stream

    You must have a genuine and realistic commitment to:

  • • Reside in the state or territory whose government agency nominated you.
  • • Continue your business and investment activity in Australia after the conclusion of your provisional visa.
  • • Live in Australia for at least 40 days per year (calculated cumulatively) for the duration of your provisional visa, or your spouse to live for at least 180 days per year (calculated cumulatively) for the duration of your provisional visa.

  • You must invest AUD 5 million: in which:

    1. At least $500,000 in eligible Australian venture capital or growth private equity (VCPE) fund(s) investing in start-up and small private companies. The Government expects to increase this to $1 million for new applications within two years as the market responds.


    2. At least $1.5 million in an eligible managed fund(s) or Listed Investment Companies (LICs) that invest in emerging companies; and,


    3. A ‘balancing investment’ of up to $3 million in managed fund(s) or LICs that invest in a combination of eligible assets that include Australian listed securities, eligible corporate bonds or notes, annuities and real property (subject to the 10 per cent limit on residential real estate).


    Premium Investor Stream: For investors looking to invest 15 million AUD in designated investment and Australian Bond.

    This Visa holder can:

  • • Apply for visa extension if holding Business Innovative visa or Significant Investor.
  • Business Innovative: can extend once more time, 2 years each.
  • Significant investor: can extend twice, 4 year each.
  • After holding 188 visa, visa holder can apply for 888 visa (Permanent Resident).


    Business Talent Visa


    Business Talent Visa (subclass 132)

  • • The Visa Applicant must:
  • • Be under 55 years old.
  • • Have total personal and business asset of AUD 1.5 million.
  • • Own business asset of AUD 400,000.
  • • Turnover: at least AUD 3 million per year.
  • • The business must be not be illegal.
